01 Acceptance of Terms

Welcome to EcomBuyer.in. By accessing, browsing, or using the EcomBuyer.in website (ecombuyer.in) or any related mobile application or service (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any other policies referenced herein.

If you do not agree to these Terms, you must not access or use the Platform. Your continued use of the Platform after any changes to these Terms constitutes your acceptance of the revised Terms.

These Terms constitute a legally binding agreement between you ("User", "you", "your") and Ecom Buyer Network Private Limited (CIN: U47912TN2024PTC166832), trading as "EcomBuyer.in" ("we", "us", "our"), a company incorporated under the laws of India.

02 Description of Service

EcomBuyer.in is an online marketplace that connects independent sellers ("Sellers") with buyers ("Buyers") for the purchase and sale of goods. EcomBuyer.in acts as an intermediary platform and is not a party to any transaction between Buyers and Sellers except where explicitly stated.

2.1 Platform Features

• Browsing and searching product listings from verified sellers
• Purchasing products using supported payment methods
• Order tracking and post-purchase support
• Seller registration, verification, and product management tools
• Customer reviews and ratings
• Promotional offers, deals, and discount programs

2.2 Availability

We strive to ensure the Platform is available 24/7, but we do not guarantee uninterrupted access. The Platform may be unavailable during scheduled maintenance or due to circumstances beyond our control.

03 User Accounts

3.1 Registration

To make purchases or sell on EcomBuyer.in, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password confidential and not share it with any third party
• Notify us immediately of any unauthorised use of your account
• Be responsible for all activity that occurs under your account

3.2 Eligibility

You must be at least 18 years of age to create an account or make purchases on EcomBuyer.in. By registering, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or posed a risk to the Platform or its users.

04 Purchases & Payments

4.1 Order Placement

When you place an order on EcomBuyer.in, you make an offer to purchase the product at the listed price. The order is confirmed only when you receive an order confirmation notification from us. We reserve the right to cancel orders due to pricing errors, stock unavailability, or suspected fraudulent activity.

4.2 Pricing

All prices are listed in Indian Rupees (₹) and are inclusive of applicable taxes unless stated otherwise. Prices may change at any time without notice. Additional charges such as shipping fees will be clearly displayed at checkout.

4.3 Payment Methods

We accept the following payment methods:

• Credit and debit cards (Visa, MasterCard, RuPay)
• Net banking
• UPI (Unified Payments Interface)
• Digital wallets
• Cash on Delivery (where available)

4.4 Payment Security

All payment transactions are processed through PCI-DSS compliant payment gateways. EcomBuyer.in does not store your full card details on its servers.

05 Shipping & Delivery

Shipping timelines and costs are determined by the individual Seller and the shipping partner selected. EcomBuyer.in is not directly responsible for delays caused by courier partners, natural events, or circumstances beyond reasonable control.

• Estimated delivery times are displayed at checkout and are indicative, not guaranteed
• Delivery timelines may vary based on your location and the seller's dispatch time
• You will receive tracking information once your order is shipped
• EcomBuyer.in is not liable for goods lost or damaged during transit beyond our facilitation

06 Returns & Refunds

6.1 Return Eligibility

Most products on EcomBuyer.in are eligible for return within 7 days of delivery, subject to the Seller's individual return policy. To be eligible for a return:

• The item must be unused and in its original condition
• The item must be in the original packaging with all accessories and tags intact
• A valid reason for return must be provided (defective, wrong item, etc.)

6.2 Non-Returnable Items

The following categories are generally not eligible for return:

• Perishable goods, food items, and consumables
• Personalised or custom-made products
• Digital downloads and software
• Items marked as "Non-Returnable" in the product listing
• Intimate apparel, swimwear, and hygiene-sensitive products

6.3 Refund Processing

Once a return is approved and the product is received and inspected, refunds are processed within 5–7 business days to the original payment method.

07 User Conduct

You agree not to use the Platform for any of the following:

• Fraudulent transactions, creating fake accounts, or impersonating others
• Posting false, misleading, or defamatory content or reviews
• Transmitting viruses, malware, or any harmful code
• Attempting to gain unauthorised access to any part of the Platform
• Scraping, crawling, or data-mining the Platform without written permission
• Using the Platform to send spam or unsolicited communications
• Violating any applicable local, state, national, or international law or regulation
• Engaging in any activity that disrupts or interferes with Platform services

Violation of these prohibitions may result in immediate account suspension and, where applicable, legal action.

08 Intellectual Property

All content on the EcomBuyer.in Platform, including but not limited to text, graphics, logos, icons, images, audio clips, and software, is the property of EcomBuyer.in or its content suppliers and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial purposes only. You must not reproduce, distribute, modify, or create derivative works without our prior written consent.

By submitting content (reviews, photos, etc.) to the Platform, you grant EcomBuyer.in a royalty-free, worldwide, perpetual licence to use, reproduce, and distribute that content in connection with our services.

09 Privacy & Data

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information and is incorporated into these Terms by reference.

By using the Platform, you consent to the collection and use of your information as described in our Privacy Policy, including the use of cookies and similar tracking technologies.

10 Disclaimers

The Platform is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Any warranty that the Platform will be uninterrupted, error-free, or free of viruses
• Any warranty regarding the accuracy, reliability, or completeness of product information provided by third-party sellers

EcomBuyer.in does not endorse any product, seller, or third-party service featured on the Platform.

11 Limitation of Liability

To the maximum extent permitted by applicable law, EcomBuyer.in and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform.

Our total aggregate liability to you for any claims arising out of or related to these Terms or your use of the Platform shall not exceed the total amount paid by you to EcomBuyer.in in the twelve (12) months preceding the event giving rise to the claim.

12 Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of India, specifically the Information Technology Act, 2000, the Consumer Protection Act, 2019, and other applicable legislation.

Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiations. If unresolved within 30 days, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with proceedings held in Tiruchirappalli, Tamil Nadu, India.

You may also raise a complaint with the relevant consumer forum under the Consumer Protection Act, 2019.

13 Changes to Terms

EcomBuyer.in reserves the right to modify these Terms at any time. When we make material changes, we will notify you by email, in-app notification, or by prominently displaying a notice on the Platform.

Changes take effect upon posting unless stated otherwise. Your continued use of the Platform after any modification constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
